This Acceptable Use Policy (“AUP”) applies to all users of the polystorage platform at polystorage.io, operated by Polystorage LLC, a Michigan limited liability company (“Polystorage,” “we,” “us,” or “our”). This includes:
- Operators and their staff — storage facility owners, managers, and any other individuals granted access to the manager portal under an operator account; and
- Tenants — individuals accessing the tenant portal.
This AUP is incorporated by reference into the Master Service Agreement (for Operators) and the Tenant Terms of Use (for Tenants). In any conflict between this AUP and those agreements, those agreements control. Capitalized terms not defined here have the meanings given in the applicable agreement.
Section 1 — General Prohibited Conduct
No user of the platform may:
1.1 Illegal Activity. Use the platform for any purpose that violates any applicable federal, state, or local law or regulation, including but not limited to consumer protection laws, data protection laws, anti-spam laws, or laws governing debt collection and tenant notification procedures.
1.2 Unauthorized Access. Attempt to access any account, system, database, or data to which you have not been expressly authorized. This includes attempting to enumerate other organizations’ data, exploit misconfigured permissions, or use credentials belonging to another user.
1.3 Interference. Interfere with, disrupt, or degrade the performance of the platform or its underlying infrastructure. This includes denial-of-service activity, credential stuffing, port scanning, vulnerability probing, or transmitting malicious code.
1.4 Harmful Content. Upload, transmit, or store any content that: (a) contains viruses, malware, ransomware, or other malicious or destructive code; (b) is defamatory, obscene, or harassing; or (c) infringes any third party’s copyright, trademark, patent, trade secret, or other intellectual property right.
1.5 Automated Scraping. Use robots, spiders, crawlers, or other automated tools to extract data from the platform except through Polystorage’s officially supported API and within any applicable rate limits. This does not prohibit using the platform’s built-in data export features.
1.6 Misrepresentation. Impersonate any person or entity, misrepresent your affiliation or authority, or provide false information to gain access to the platform or any account.
Section 2 — Operator-Specific Prohibitions
In addition to the general prohibitions above, Operators and their staff must not:
2.1 Unauthorized Lien Actions. Initiate or record lien enforcement actions, auction entries, or related legal workflow steps through the platform without first verifying compliance with the applicable state self-storage lien law, including applicable notice periods, certified mail requirements, publication requirements, and required statutory language. Using the platform’s lien workflow tools does not substitute for this legal verification.
2.2 Prohibited Communications. Use the platform’s email or announcement tools to send:
- Unsolicited commercial messages (spam) to tenants or other recipients;
- Misleading, threatening, or harassing communications to tenants; or
- Communications that violate the Fair Debt Collection Practices Act (FDCPA) or applicable state debt collection laws, to the extent those laws apply to the Operator’s collection activities.
2.3 Prohibited Payment Practices. Apply a convenience fee to tenants in any state where such fees are prohibited or restricted by applicable law without first obtaining independent legal confirmation that the specific fee structure is lawful in that state.
2.4 Data Misuse. Use tenant personal data collected through the platform for any purpose other than operating the storage facility, communicating with tenants about their unit or lease, and complying with applicable legal obligations. Specifically, Operators must not:
- Sell tenant personal data to third parties;
- Use tenant contact information for marketing unrelated to the rented storage unit without tenant consent; or
- Share tenant personal data with other operators or third parties except as required by law or as expressly authorized by the tenant.
2.5 Unauthorized Sub-Licensing. Grant access to the platform to individuals or entities not affiliated with the Operator’s storage facility operations, including reselling, sublicensing, or white-labeling access to the Service.
2.6 Malicious File Uploads. Upload to the platform’s document vault or any file upload feature any file containing malicious code, or any file that exceeds the applicable size limits, or any file format not supported by the platform’s document processing workflow.
Section 3 — Tenant-Specific Prohibitions
In addition to the general prohibitions above, Tenants must not:
3.1 Payment Fraud. Attempt to make payments through the portal using fraudulent, stolen, or unauthorized payment methods. Initiating illegitimate chargebacks or payment disputes for transactions you authorized is prohibited.
3.2 False Information. Submit false or misleading information through the portal about your identity, your unit, your lease status, or your military status for the purpose of delaying or preventing lawful enforcement actions.
3.3 Account Sharing. Share your portal login credentials with individuals who are not authorized by your Facility to access your account.
Section 4 — Reporting Violations
If you believe someone is using the platform in violation of this AUP — including unauthorized access, data misuse, or prohibited communications — please report it to us at:
Email: security@polystorage.io
We investigate all credible reports and will respond to confirmed security incidents as described in the Data Processing Agreement.
Section 5 — Enforcement
5.1 Polystorage’s Rights. Polystorage reserves the right to investigate suspected violations of this AUP. If we determine, in our reasonable judgment, that a violation has occurred or is occurring, we may:
- Suspend or terminate the offending account immediately and without prior notice where the violation creates a security risk or legal liability;
- Remove or disable access to content that violates this AUP;
- Disclose information to law enforcement or regulatory authorities as required by law or to protect our rights, our customers, or the public; and
- Pursue any other remedies available at law or equity.
5.2 Effect on Agreement. A material violation of this AUP constitutes a material breach of the applicable agreement (MSA or Tenant Terms of Use) and may result in termination as provided in that agreement.
5.3 No Obligation to Monitor. We are not obligated to monitor the platform for AUP violations and are not liable for failing to detect or act on a violation. Our enforcement rights are permissive, not mandatory.
Section 6 — Changes to This Policy
We may update this AUP from time to time. We will post the revised AUP at polystorage.io/legal/aup with an updated effective date and provide at least thirty (30) days’ written notice to Operators of material changes. Tenants will be notified through the tenant portal. Continued use of the platform after the effective date of any change constitutes acceptance of non-material changes. Notwithstanding the foregoing, material changes to this AUP as incorporated into the Master Service Agreement require affirmative acceptance through the operator dashboard before taking effect, as provided in MSA Section 11.2; the continued-use standard applies only to non-material changes and to Tenants.
